Drunk-driving or intoxicated driving in Massachusetts must be taken seriously. This state has some of the harshest penalties for Operating Under the Influence (OUI, also known as DUI), including the longest maximum jail time and license suspension periods in the US. Even a first-offense OUI conviction could take away your freedom for longer than you might think.
You shouldn’t settle for mediocre defense against an OUI/DUI charge. Entrust your case to a top-notch defense lawyer from Goldman Law, LLC. Protecting You From Massachusetts’s Severe DUI/OUI Penalties
While other states give some leniency to first-time DUI offenders, Massachusetts imposes a jail sentence of up to 2.5 years and a license suspension period of 1 year for a first OUI conviction. Typically, that means a stint in state prison, a far different experience than in the local county jail. The punishments only get more severe with subsequent convictions, with prison sentences of up to 5 years and license revocation for up to 8 years.
These penalties can have far-reaching effects on your life. You could lose not just your freedom but also your ability to drive, go to work or school, and participate in social activities – and these limitations could last for a long time.
As soon as you’re arrested for or charged with OUI, call Goldman Law. We are experienced in DUI defense, having obtained lower charges, case dismissals, and Not Guilty verdicts. We take on a wide range of vehicular crime cases, from simple misdemeanors to complex aggravated felonies. Even if you believe you’re facing a difficult charge, call us and let our skills work for you.
What Counts As Massachusetts OUI?
Operating Under the Influence (OUI) means operating a motor vehicle while impaired by alcohol or drugs. In Massachusetts, a person who is 21 years old or older is considered alcohol-impaired if their blood alcohol concentration (BAC) is .08 percent. If the person is under 21, the BAC limit is .02 percent.
Note that OUI is more than just drunk-driving. Under Massachusetts state law, officers may apprehend drivers whom they believe to have taken marijuana, narcotics, stimulants, or depressants. Many times, drivers have been arrested due to prescription drugs being found in their system.
Call a lawyer as soon as you’re accused of intoxicated driving. You have the right to refuse to answer the officer’s questions without your attorney, in fact, it is a good general rule not to. A wrong or improperly framed answer at the accident scene or at first lockup may harm your case in every judicial proceeding that follows.
Defenses Against DUI/OUI in Massachusetts
Goldman Law attorneys are well-versed in DUI defenses, but our team doesn’t merely apply any defense to your case. We craft a defense strategy specifically for your situation, aiming to minimize your exposure to OUI penalties. These are only some of the defenses we may use:
- Challenging the legality of the police stop
- Challenging the conduct of your field sobriety test
- Contesting the validity of your Breathalyzer result
- Citing Miranda violations or unlawful arrest
- Scrutinizing the handling of evidence.
Many types of defenses are designed to exclude harmful evidence from the case and weaken the prosecution’s position. At Goldman Law, we’re fearless when negotiating with prosecutors and assertive when advocating for your rights. And if your case goes to trial, our attorneys can competently represent you in court, backed by decades of experience in bench trials and jury trials.
